美國勞工移民是美國移民局 (USCIS)轄下第三類優先就業類的移民簽證 (Employment-based Third Preference Immigrant Visas),簡稱“EB-3”。此項目在市場上的中文別稱有很多,如僱主擔保移民﹑非技術移民﹑低技術移民﹑職業移民﹑勞工移民等。

美國勞工市場長期缺乏某些專業類(如醫護﹑護理等)、技術類 (如IT﹑工程師等)及非技術類(如清潔﹑包裝﹑肉類加工等)勞動人口。在供求失衡下,美國僱主需在他國輸入外勞,填補此類美國勞工市場的長期空缺。在美國僱主擔保下,申請人透過EB-3途徑申請,從而獲取永久居民簽證,再到美國工作。正是我們所說的「先移民.後工作」。符合特定居住要求後,更可申請成為美國公民,取得美國護照。

申請人的基本要求:

申請流程:

向美國勞工部 (DOL)提交申請及獲得認可勞工證Labor Certification (簡稱LC)

向美國移民局(USCIS)提交I-140移民申請並獲得批核 

向國家簽證中心(NVC)提交DS-260移民簽證申請

U.S. Labor Immigration is the Employment-based Third Preference Immigrant Visa under the USCIS and is also known as “EB-3”. There are many Chinese aliases for this program in the market, such as employer-sponsored immigration, unskilled immigration, low-skilled immigration, professional immigration, and labor immigration. 

The U.S. labor market has been in lack of labor in certain independent Skilled Categories (e.g. healthcare, nursing, etc.) and Non-skilled Categories (e.g. cleaning, packaging, and meat processing). Under the imbalance between supply and demand, U.S. employers need to import foreign workers from other countries to fill such a long-term vacancies in the US labor market. Under a U.S. employer’s sponsor, the applicant applies through the EB-3 route to obtain a permanent resident visa and then work in the United States. It is precisely what we call “Migration first, work after.” After meeting specific residing requirements, you can apply to become a U.S. citizen and obtain a U.S. passport.
